Application for an E-2 Investor Visa
To apply for an E-2 US investor visa, you must first demonstrate that the business meets all legal requirements. You may also be asked to give proof that your stay in the United States will be transitory.
Your E-2 visa application paperwork must include:
- DOS Form DS-160, Nonimmigrant Visa Application
- Form DS-156E, Application for Nonimmigrant Status as a Treaty Trader or Investor
- A copy of your passport with at least one blank page that is valid for at least six months beyond your intended term of stay in the United States.
- A passport-style photograph of the subject’s complete face without a head covering, on a light background.
- If required by a religious order of which you are a member, you may wear a headpiece.
- A business plan outlining planned future investments
- Your curriculum vitae
- Evidence that you will be engaged in a managerial or executive capacity, or that you possess highly specialized skills critical to the organization’s efficient running.
- Proof of possession and management of investment funds (bank records, financial statements, loans, savings, or promissory notes)
- Proof of remittances to the United States (bank drafts, transfers exchange permits or receipts.)
- Evidence of business establishment in the United States (articles of incorporation, partnership agreement, organization and staffing charts, shares, titles, contracts, receipts, licenses or leases.)
- Evidence of the investors’ nationality (passports, articles of incorporation of parent company or stock exchange listings.)
- Proof of investment in the United States (titles, receipts, contracts, loans or bank statements.)
- Evidence of significance (financial statements, audits, U.S. corporate or business tax returns.)
- Evidence that the business is not insignificant (payroll records, IRS Form 941, personal tax returns, evidence of other personal assets and income)
- Evidence that the enterprise is actual and operational (annual reports, catalogs, sales literature, news articles, and other evidence as appropriate)
